01Service Description
Denpath ("we", "us", "the Service") is a dental practice management platform that enables practices to create, manage, and communicate treatment plans with patients. The Service is provided via denpath.co.uk.
02Account Terms
- You must provide accurate and complete registration information
- You are responsible for maintaining account security and all activity under your account
- One person or legal entity per account unless otherwise agreed
- You must be 18 or older to use the Service
- You must notify us immediately of any unauthorised access
- Creating an account requires accepting these Terms and our Privacy Policy; creating a practice additionally requires accepting our Data Processing Agreement on the practice's behalf
03Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious code or attempt to compromise system security
- Interfere with or disrupt the Service or its infrastructure
- Share account credentials with unauthorised parties
- Use the Service to store data unrelated to dental practice management
- Resell or redistribute the Service without written permission
04Data Ownership
You retain all rights to data you enter into the Service. We do not claim ownership of your practice data, patient records, or treatment plans. You grant us a limited licence to host, store, and process your data solely to provide the Service. Upon account termination, you may request export of your data.
05Data Protection
You are responsible for ensuring you have appropriate legal basis (e.g. patient consent) to enter patient data into the Service, and for how long professional record-keeping obligations require you to retain it — deleting a patient record in the Service is immediate and permanent. We process data in accordance with our Privacy Policy, our Data Processing Agreement, and UK GDPR. Both parties agree to comply with applicable data protection legislation.
06Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We reserve the right to modify or discontinue features with notice.
07Liability Limitations
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
- We are not responsible for clinical decisions made using information from the Service
- Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law
08Payment Terms
If applicable, fees are billed in advance on a recurring basis. All fees are non-refundable unless required by law. We may change pricing with 30 days notice. Failure to pay may result in account suspension.
09Termination
Either party may terminate at any time. You may close your account by contacting us. We may suspend or terminate accounts that violate these terms or remain inactive for an extended period. Upon termination, your right to use the Service ceases. We will retain data for a reasonable period to allow export, after which it will be deleted.
10Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11Changes to Terms
We may revise these terms at any time. Material changes will be communicated with at least 30 days notice via email or in-app notification. Continued use after changes take effect constitutes acceptance.
